Dear Lyndon.  I thought you might like to read an article entitled: EPA ISSUES GUIDANCE ON THE EXEMPTION OF MINIMUM RISK PESTICIDES UNDER FIFRA SECTION 25(B).

On May 24, 2000, EPA issued guidance on the exemption from regulation under the Federal  Insecticide, Fungicide, and Rodenticide Act (FIFRA) of pesticides which pose little or no risk to human health and the environment. The Agency has issued a Pesticide Registration (PR) Notice (2000-6) to clarify several aspects of the exemption of these "minimum-risk pesticides" under FIFRA  Section 25(b).   In 1996, EPA exempted certain minimum-risk pesticides from FIFRA requirements as long as they satisfy certain conditions related to their toxicity and exposure profiles.  This exemption reduces the cost and regulatory burdens on businesses and the public, and it allows the Agency to focus its limited resources on pesticides which pose greater  risk to human health  and the environment.  The new PR Notice will answer many of the questions registrants frequently have asked about minimum-risk pesticides that qualify for this exemption, such as their composition, labeling, food tolerances, and state regulation.

Interested parties may submit comments on PR 2000-6, which is available on EPA's web site at :-  www.epa.gov/opppmsd1/PR_Notices/pr2000-6.pdf. A Federal Register Notice announcing the availability of the PR Notice is available on EPA's web site at:-  www.epa.gov/fedrgstr/EPA-PEST/2000/May/Day-24/p12960.htm  The Agency is accepting comments on this PR Notice for 30-days after publication, and, if necessary, a final PR Notice will be issued by the end of 2000.  For additional information on this PR Notice, please contact Brian Steinwand in the Biopesticides and Pollution Prevention Division at (703) 305-7973;    steinwand.brian@epa.gov

Well Lyndon, Are unregistered safe "pesticides now legal" in California?  Or will you demand that even safe alternatives still be "registered"?

Respectfully,  Stephen L. Tvedten
