SUMMARY:

 

Amd S33-0905, En Con L

Requires written notice of at least 48 hours to be provided to the occupants of all adjacent land of property on which the proposed application of a pesticide either on the exterior premises of any dwelling or building is impending; provides that nothing shall preclude the commissioner of environmental conservation from promulgating regulations to ensure that all persons who may come into contact with pesticides are fully informed of the dangers of such contact.

AN ACT to amend the  environmental  conservation  law,  in  relation  to requiring notice of application of pesticides

The  People of the State of New York, represented in Senate and Assembly, do enact as follows: 

1    Section 1. Paragraph d of subdivision 5  of  section  33-0905  of  the

2  environmental  conservation  law, as added by chapter 612 of the laws of

3  1983, is amended to read as follows:

4    d. For the purposes of this subdivision:

5    (i) "Adjacent land" shall mean any premises which have any  boundaries

6  in  common  with  the  premises  on  which a pesticide is to be applied,

7  including those premises which would share a common boundary if it  were

8  not for an intervening roadway or right of way;

9    (ii)  A  "dwelling"  is  any  building or structure or portion thereof

10  which is occupied in whole or in part as the home, residence or sleeping

11  place for one or two families;

12    [(ii)] (iii) A "multiple dwelling" shall mean any dwelling which is to

13  be occupied by or is occupied as the residence or home of three or  more

14  families living independently of each other;

15    [(iii)]  (iv)  A "multiple dwelling unit" shall mean that portion of a

16  multiple dwelling occupied by one or more persons as  the  residence  or

17  home of such persons; and

18    [(iv)] (v) "Premises" shall mean land and improvements or appurtenanc-

19  es or any part thereof.

20    §  2.  Subdivision 5 of section 33-0905 of the environmental conserva-

21  tion law is amended by adding a new paragraph c-1 to read as follows:

1    c-1. Every certified applicator  shall,  at  least  forty-eight  hours

2  prior to application of a pesticide on the exterior premises of a dwell-

3  ing,  multiple  dwelling,  building, or structure other than a dwelling,

4  supply the occupants of all adjacent land with a  written  copy  of  the

5  information,  including  all  warnings,  contained  on  the label of the

6  pesticide to be applied.

7    § 3. Section 33-0905 of the environmental conservation law is  amended

8  by adding a new subdivision 6 to read as follows:

9    6.  Nothing  herein  shall preclude the commissioner from promulgating

10  rules and regulations governing  notice  of  pesticide  applications  in

11  order  to  ensure that all persons who may be exposed to a pesticide are

12  fully informed of the dangers inherent in exposure and  the  precautions

13  which may be taken to minimize or eliminate those dangers, nor shall the

14  commissioner be precluded from modifying or waiving any obligation under

15  this  section if compliance would impose an undue hardship on the person

16  to whom the obligation applies.

17    § 4. This act shall take effect on the first  day  of  September  next

18  succeeding the date on which it shall have become a law.
