EPA goes after another "unregistered pesticide"
(Dusban and Diazianon are allowed to be freely sold even after EPA determined they were harmful.)

EPA Fines Pet Smart
ELMWOOD PARK, October 29, 2001 (CN)--The U.S. Environmental Protection Agency has filed a complaint against Pet Smart Inc. for selling and distributing several unregistered products with pesticide-type claims and failing to provide shipping records. According to EPA inspectors Pet Smart stores located at 2665 Elston Ave., Chicago, and 6655 W. Grand Ave., Elmwood Park, Ill., illegally sold or distributed: Pet Organics "No Stay!" Furniture Spray for Dogs, Pet Organics "No Dig! Lawn and Yard Spray", Pet Organics "Pet Stopper Spray for Plants and Shrubbery" and Pet Organics "No Scratch for Cats."
The labels imply that the products repel dogs and cats from objects on which it is applied. Under the Federal Insecticide, Fungicide and Rodenticide Act, pesticides are defined as substances intended to prevent, destroy, repel or stop any pest and must be registered and given a registration number by EPA before they can be sold or distributed in the United States. This process insures that the pesticide does not pose an unreasonable risk to human health or the environment. The EPA has issued a fine of $45,000 for the offenses.
