EPA and CATs Sign Consent Decree
EPA has entered into a Consent Decree that resolves a lawsuit brought against the Agency by the Californians for Alternatives to Toxics (CATs), the Environmental Protection Information Center, and the Humboldt Watershed Council.
The Consent Decree establishes deadlines for the Agency to consult with the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) on potential effects of certain pesticides to specific endangered or threatened plant and salmonid species located primarily in California. EPA published a Federal Register Notice on April 30, 2002, seeking public comment on the proposed Consent Decree. After reviewing all comments, EPA and the plaintiffs renegotiated the schedule for two aspects of the Consent Decree to include further public participation.
