Dear Mr. English:
Thank you for sending me the correspondence you received from Mr. Alan J. Bengyel, Fairfax Town Administrator, concerning notification requirements for pesticide applications. As I mentioned to you in our conversation, the ordinances adopted by the Town of Fairfax pertaining to pesticide use on private property in that town are superceded by state statute. Consequently, as long as you are in compliance with all applicable state laws and regulations concerning pesticide use, you may consider any additional requirements proposed by the Town of Fairfax to be inapplicable, as they are null and void.
For your information, enclosed is a copy of my notice to the Town of Fairfax stating that their ordinances pertaining to pesticide use on private property are in violation of state statute.
